1. Agreement to Terms
These Terms & Conditions ("Terms") constitute a legally binding agreement between you and Kalidas Aneesh (professionally operating as KALIUM), regarding your access to and use of this website (including all subdomains, media catalogs, digital stores, and interactive features).
By accessing the site, downloading digital assets, placing an order, or submitting a payment via Razorpay, you acknowledge that you have read, understood, and agreed to be bound by these Terms and our companion policies: Privacy Policy and Refund & Delivery Policy. If you do not agree, you must immediately discontinue use of the site.
2. Intellectual Property & Remix Policy
Original Works: All original musical compositions (including Silence, Memory, Aera, Alone, Don't Hold Back, Cause of You), original sound design libraries, synthesizer preset banks, visual artworks, motion graphics, and website code created by KALIUM are protected under the Indian Copyright Act, 1957 and international copyright conventions.
Non-Commercial Bootlegs & Remix Showcase Disclaimer: Unofficial remixes, bootlegs, and edits featured on this website are provided strictly as non-commercial artistic demonstrations for promotional and DJ showcase purposes. All rights to the underlying musical compositions, lyrics, and original master recordings remain the exclusive intellectual property of the original copyright owners, record labels, and publishers. No transfer of ownership or commercial mechanical synchronization rights is granted or implied.
Any payments made through the "Pay What You Want" or tipping modules for remix downloads represent voluntary financial contributions towards KALIUM's independent creative time, studio operations, and server hosting bandwidth, and do not constitute a commercial sale or purchase of third-party copyrighted sound recordings.
2.1 Copyright Notice & Takedown Procedure
KALIUM respects the intellectual property rights of all artists, songwriters, record labels, and publishers. If you are a copyright owner or authorized representative and believe that any remix, bootleg, or audio file on this website infringes upon your intellectual property rights, please submit a notice directly to our designated email:
Required Details: (1) The specific track title / URL, (2) Proof of copyright ownership or representation, and (3) Contact details.
Commitment: KALIUM will expeditiously review and voluntarily remove or disable public access to any disputed audio material within 24 to 48 hours of verified notice.
3. Digital Products & Sound Vault Access
Digital products available on this website (including Notion creator dashboards, digital eBooks, FL Studio templates, 4K wallpapers, and audio masters) are delivered electronically via instantaneous web download links and email notifications upon verified payment or lead request.
- Grant of License for Creator Assets: Purchases and downloads of creator templates, eBooks, and digital masters grant you a worldwide, royalty-free, non-exclusive license to use the templates in your personal or commercial production workflows, or enjoy audio files for personal entertainment and non-commercial DJ performance.
- Prohibited Redistribution: You may not resell, sub-license, repackage, or publicly redistribute KALIUM Notion workspaces, eBook chapters, or project templates in isolation as competing standalone digital products.
- Lossless Archive: Access to files stored in your Customer Vault is tied to the email address used during checkout. KALIUM maintains good-faith backup access but encourages users to maintain local offline backups of all acquired digital files.
4. Commercial Sponsorships & Rate Card
The commercial figures, reach calculations, and engagement metrics displayed on brands.html and rate-card.html represent historical creator performance averages and transparent rate benchmarks.
Engagement projections (e.g. 7.2% ER) reflect historical audience averages and do not constitute legally guaranteed performance targets. All commercial brand sponsorships, hardware review deliverables, and dedicated video integrations become binding only upon mutual execution of a formal commercial Statement of Work (SOW) or written sponsorship agreement.
5. Payments & Financial Transactions
All financial transactions on this website are processed through Razorpay (Razorpay Software Private Limited), an RBI-authorized Payment Aggregator supporting UPI, Net Banking, Debit/Credit Cards, and international payment rails.
KALIUM does not store or process debit/credit card numbers or CVVs on local servers. All payment processing complies with PCI-DSS standards maintained directly by Razorpay.
6. Limitation of Liability
To the maximum extent permitted by applicable Indian law, KALIUM and Kalidas Aneesh shall not be liable for any indirect, incidental, punitive, or consequential damages arising from the use of this website, service interruptions, or digital file compatibility issues with your specific digital audio workstation (DAW) or hardware.
7. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or related to these Terms or transactions conducted on this website shall be subject to the exclusive jurisdiction of the competent courts in Bengaluru, Karnataka, India.
